Terms and Conditions
When purchasing and signing up for a course, private coaching, or group coaching through Swanson Coaching LLC, I hereby acknowledge and agree:
1) Swanson Coaching LLC (Coach) focuses on overall wellness through coaching techniques to achieve optimal mental, emotional, spiritual, energetic, and physical health. Coach primarily assists and supports clients to assume more personal responsibility for their wellness by adopting a healthy attitude and lifestyle. While people generally experience greater wellness as a result of embracing a healthier attitude and lifestyle, Coach does not promise or guarantee results or protection from future issues (including disorders or diseases).
2) I understand that Coach is not a physician or psychologist, psychoanalyst, therapist, nutritionist, or dietician, and the scope of her consultation services does not include treatment or diagnosis of specific illnesses or disorders. As such, Coach will not be held liable for failure to diagnose or treat physical or mental illness, nor will Coach be liable for failure to prevent future illness. Coach does not assist in reading lab work or suggesting lab work to client.
3) If Coach suspects the existence of a disease, disorder or condition, I (client) will be informed of this suspicion. However, I acknowledge this is not a diagnosis or conclusion about the state of my health and that I am directed to promptly consult a licensed Physician or Practitioner about any suspected problems.
4) As part of Swanson Coaching LLC Services, I may be asked to provide information concerning my physical habits, personal history, moods, energy levels, likes and dislikes, and lifestyle. This information is collected to enable Coach to: (i) assess my knowledge of lifestyle, (ii) educate me about the benefits of sound practices and (iii) invite lifestyle changes to improve my general health, vitality, and overall well-being. Coach will hold this information in confidence and will not release or disclose this information to any other person, without my prior consent, except as required by applicable law.
5) It is understood that if I (Client) suspect I may have an ailment or illness that may require medical attention, then I will consult with a licensed physician without delay. Only a licensed physician can prescribe medication/drugs. Any mention of meds/drugs in the course of coaching is solely for the purpose of providing a complete history of meds/drugs that the client is taking and not for Coach to judge the appropriateness of the medication. Any change in prescription or dosage is the decision I, (Client), make with my physician.
6) Should I request Coach to recommend lifestyle changes to enhance my body’s natural ability to resist and/or overcome a known disease, disorder, or condition, it is my responsibility to disclose the nature of the disease, disorder or condition and all other relevant details to the Coach. If I have not previously consulted a licensed Physician or Practitioner about this disease, disorder, or condition, I acknowledge that I am directed to promptly do so. I am not to alter or discontinue treatments prescribed by a licensed Practitioner or Physician or other licensed health professionals without consulting the individual who prescribed the treatment.
7) In providing Coaching services to me, Coach is relying upon the truth, accuracy and completeness of all information I have provided to her. Any recommendations I follow for changes in diet or lifestyle, including the use of nutritional supplements, are entirely my responsibility.
8) Coach is in no way liable for my health or safety. Client will not be driving or otherwise distracted while being coached either one-on-one or in a group setting. In addition, I have given Coach a complete and accurate account of any mental, emotional, physical, or medical conditions that I may have and any medications that I am taking.
9) Recordings, Case Studies, and release of information:
a) Coaching sessions may at times be recorded or used for case study presentations or certification purposes. Case studies are always presented anonymously with the Client's privacy in mind. I (client) will always be asked prior to submitting a recording for a case study or certification.
b) Private session recordings are used for training and development purposes only and, again, your anonymity will be preserved. I will always be notified when a recording is started and may decline to be recorded. Before sharing any of my session recordings with a coaching mentor, supervisor or assessor, Coach will always ask for my written consent pertaining to the restricted release of a particular session recording first. I may also request a copy of any of these session recordings at anytime, and if a recording of that session has been made, it will be made accessible to me. If you would prefer that none of your sessions are recorded/used for case studies, you may also advise Coach accordingly.
c) Group coaching sessions and Q&A sessions may at times be recorded and uploaded to a program dashboard for course/program participants. Coach and all participants agree to hold the contents and discussions of any group sessions in the strictest of confidence and will not share any identifying information of other participants anywhere outside of the course/program. Course participants will not record any sessions for personal purposes. Course participants will not share recordings. Recordings will be available only in the course dashboard.
d) Release of Information: Coach engages in training and continuing education pursuing and/or maintaining ICF (International Coach Federation) and NBHWC (National Board for Health and Wellness Coaching) Credentials. That process requires the names and contact information of all Clients for possible verification by ICF/NBHWC. By signing this agreement, I agree to have only my name, contact information (email and/or phone) and start and end dates of coaching shared with ICF/NBHWC staff members and/or other parties involved in this process for the sole and necessary purpose of verifying the coaching relationship. No personal notes will be shared. According to the ethics of the Coaching profession, topics may be anonymously and hypothetically shared with other coaching professionals for training, supervision, mentoring, evaluation, and for coach professional development and/or consultation purposes.
10) Participants will have access to the course for the lifetime of a course or program unless otherwise stated. The content of the course may be updated from time to time and some material may be removed and/or replaced. All content is the property of Coach and Swanson Coaching, LLC and may not be shared or reproduced in any manner.
11) Refunds and money-back guarantees:
a) Live online courses: There is a 14-day money-back guarantee from the start date of the program (the first live group session). If for any reason you are not satisfied, please contact us within 14 days of the course start date for a full refund minus a small processing fee via the method paid when registering. All refund requests must be submitted in writing via email to: [email protected]. Any refund requests after 14 days will not be considered.
b) Group coaching programs: If for any reason you are not satisfied, please contact within 7 days of the program us for a refund of any remaining sessions minus a small processing fee. All refund requests must be submitted in writing via email to: [email protected]. Any refund requests after 7 days from program start date will not be considered.
c) For private one-on-one packages, if Client decides to discontinue work with Coach, Client will be reimbursed for unused sessions minus a small processing fee.
d) All sales are final for all Self-led or "Evergreen" courses due to the immediate access to course materials.
e) All sales are final for Enneagram Typing Sessions or one-on-one coaching sessions not purchased as part of a package.
12) In consideration of my participation in the coaching sessions or programs, I hereby accept all risk to my health, including injury or death that may result from such participation and I hereby release Sandy Swanson and Swanson Coaching LLC, on my behalf and on behalf of my personal representatives, estate, heirs, next of kin, and assigns from any and all costs, claims, causes of action and damages arising from any and all illness or injury to my person, including my death, that may result from or occur as a result of my participation in coaching with Sandy Swanson or Swanson Coaching programs, whether caused by negligence or otherwise.
13) I understand that any practices I undertake at Swanson Coaching LLC are undertaken of my own free will. I accept that the ultimate responsibility for my health care is my own and that Swanson Coaching LLC is here to support me in this. I understand that my practitioner reserves the right to determine which cases fall outside their scope of practice, in which event an appropriate referral will be recommended. I hereby agree to assume full responsibility for any manner of loss, injury, claim or damage whatsoever, known or unknown, incurred as a result of same and I, my heirs, executors, administrators or assigns for any loss, injury, claim or damage sustained as a result of my attendance and/or participation. I have read the above release and waiver of liability, and fully understand its contents and voluntarily agree to the terms and conditions stated.
14) By signing up to work with Sandy Swanson and Swanson Coaching, LLC either privately or for a program or course, I acknowledge that I understand that Sandy Swanson is a Wellness Coach only, and that I should see a doctor or licensed practitioner or therapist if I think I have a physical medical condition or need support for clinical concerns like severe anxiety or depression. Sandy Swanson and Swanson Coaching, LLC will not be held liable for failure to diagnose or treat an illness, nor will she/he be liable for failure to prevent future illness.
I hereby agree to assume full responsibility for any manner of loss, injury, claim or damage whatsoever, known or unknown, incurred as a result of same and I, my heirs, executors, administrators or assigns for any loss, injury, claim or damage sustained as a result of my attendance and/or participation.
